The Book of Oaths (qasamah), Retaliation and Blood Money

أَخْبَرَنَا هِلاَلُ بْنُ الْعَلاَءِ بْنِ هِلاَلٍ، قَالَ حَدَّثَنَا سَعِيدُ بْنُ سُلَيْمَانَ، قَالَ أَنْبَأَنَا سُلَيْمَانُ بْنُ كَثِيرٍ، قَالَ حَدَّثَنَا عَمْرُو بْنُ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " مَنْ قُتِلَ فِي عِمِّيَا أَوْ رِمِّيَا تَكُونُ بَيْنَهُمْ بِحَجَرٍ أَوْ سَوْطٍ أَوْ بِعَصًا فَعَقْلُهُ عَقْلُ خَطَإٍ وَمَنْ قَتَلَ عَمْدًا فَقَوَدُ يَدِهِ فَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَالْمَلاَئِكَةِ وَالنَّاسِ أَجْمَعِينَ لاَ يُقْبَلُ مِنْهُ صَرْفٌ وَلاَ عَدْلٌ " .
Rapporté par Ibn 'Abbas : Le Messager d’Allah ﷺ a dit : « Celui qui est tué accidentellement ou par un objet lancé, alors qu’il y a entre eux une pierre, un fouet ou un bâton, la compensation à payer est celle pour un homicide involontaire. Celui qui tue volontairement, alors la rétorsion s’applique à lui, et celui qui essaie d’empêcher cela subit la malédiction d’Allah, des Anges et de tous les gens, et aucune compensation ni échange ne sera acceptée de lui. »It was narrated that Ibn 'Abbas said:"The Messenger of Allah said: 'Whoever is killed in the blind or by something thrown, while between them is a rock, a wipe, or a stick, then the blood money of be paid for him is the blood money for accidental killing. Whoever kills deliberately, then retaliation is upon him, and whoever tries to prevent that, upon him is the curse of Allah, the Angels, and all the people, and neither Sarf nor Adl will be accepted from himDegrés donnés par les savants
