Sunan Ibn Majah, 2724

Rapporté par Ibn Dhu’aib : Une grand-mère est venue voir Abu Bakr Siddiq et lui a demandé sa part d’héritage. Abu Bakr lui a dit : “Tu n’as rien selon le Livre d’Allah, et je ne connais rien pour toi selon le Livre d’Allah, ni selon la Sunna du Messager d’Allah (ﷺ). Retourne chez toi pendant que je consulte les gens.” Il a donc interrogé les gens et Al-Mughirah bin Shu’bah a dit : “J’étais présent avec le Messager d’Allah (ﷺ) et il lui a donné (à la grand-mère) un sixième.” Abu Bakr a dit : “Y a-t-il quelqu’un d’autre avec toi (pour confirmer ce que tu dis) ?” Muhammad bin Maslamah Al-Ansari s’est levé et a dit quelque chose de semblable à ce qu’a dit Mughirah bin Shu’bah. Alors Abu Bakr a appliqué cette règle pour elle

It was narrated that Ibn Dhu’aib said:“A grandmother came to Abu Bakr Siddiq and asked him for her inheritance. Abu Bakr said to her: ‘You have nothing according to the Book of Allah, and I don’t know of anything for you according to the Book of Allah, and I don’t know of anything for you according to the Sunnah of the Messenger of Allah (ﷺ). Go back until I ask the people.’ So he asked the people and Al-Mughirah bin Shu’bah said: ‘I was present with the Messenger of Allah (ﷺ) and he gave her (the grandmother) one sixth.’ Abu Bakr said: ‘Is there anyone else with you (who will corroborate what you say)?’ Muhammad bin Maslamah Al-Ansari stood up and said something like what Mughirah bin Shu’bah had said. So Abu Bakr applied it in her case.”
