Sunan Ibn Majah, 2462

Rapporté par 'Amr bin Dinar : J’ai dit à Tawus : “Ô Abu 'Abdur-Rahman, pourquoi n’abandonnes-tu pas cette Mukhabarah, puisqu’ils disent que le Messager d’Allah (ﷺ) l’a interdite ?” Il a répondu : “Ô 'Amr, je les aide en prenant leur terre, en la cultivant et en leur donnant une part en échange, et Mu‘adh bin Jabal a permis aux gens ici de le faire. Le plus savant d’entre eux – c’est-à-dire Ibn 'Abbas – m’a dit que le Messager d’Allah (ﷺ) ne l’a pas interdite, mais il a dit : ‘Pour l’un de vous, donner (sa terre) à son frère est mieux que de recevoir un loyer fixe pour elle.’”

It was narrated that 'Amr bin Dinar said:I said to Tawus: “O Abu 'Abdur-Rahman, why do you not give up this Mukhabarah because they claim that the Messenger of Allah (ﷺ) forbade it.” He said: “O 'Amr, I help them by taking their land and cultivating it, and giving them something in return, and Mu`adh bin Jabal allowed people here to do that. The most knowledgeable of them - meaning Ibn`Abbas - told me that the Messenger of Allah (ﷺ) did not forbid it, rather he said: 'For one you to give (land) to his brother is better than if he were to take a set amount in rent for it.'”
