Sahih al-Bukhari, 4019

Rapporté par ‘Ubaidullah bin ‘Adi bin Al-Khiyar : Al-Miqdad bin ‘Amr Al-Kindi, qui était un allié des Bani Zuhra et avait combattu à Badr avec le Messager d’Allah (ﷺ), lui a raconté qu’il avait dit au Messager d’Allah (ﷺ) : « Supposons que je rencontre un mécréant, que nous nous battions, qu’il me coupe une main avec son épée puis qu’il se réfugie dans un arbre en disant : “Je me soumets à Allah (c’est-à-dire je deviens musulman)”, pourrais-je le tuer, ô Messager d’Allah (ﷺ), après qu’il ait dit cela ? » Le Messager d’Allah (ﷺ) a dit : « Tu ne dois pas le tuer. » Al-Miqdad a dit : « Ô Messager d’Allah (ﷺ) ! Mais il m’a coupé une main, puis il a prononcé ces paroles ? » Le Messager d’Allah (ﷺ) a répondu : « Tu ne dois pas le tuer, car si tu le tues, il serait à ta place avant que tu ne le tues, et tu serais à sa place avant qu’il ne dise ces paroles. »

Narrated 'Ubaidullah bin `Adi bin Al-Khiyar:That Al-Miqdad bin `Amr Al-Kindi, who was an ally of Bani Zuhra and one of those who fought the battle of Badr together with Allah's Messenger (ﷺ) told him that he said to Allah's Messenger (ﷺ), "Suppose I met one of the infidels and we fought, and he struck one of my hands with his sword and cut it off and then took refuge in a tree and said, "I surrender to Allah (i.e. I have become a Muslim),' could I kill him, O Allah's Messenger (ﷺ), after he had said this?" Allah's Messenger (ﷺ) said, "You should not kill him." Al- Miqdad said, "O Allah's Messenger (ﷺ)! But he had cut off one of my two hands, and then he had uttered those words?" Allah's Messenger (ﷺ) replied, "You should not kill him, for if you kill him, he would be in your position where you had been before killing him, and you would be in his position where he had been before uttering those words
