Sunan Abi Dawud, 4417

Rapporté par Ubadah ibn as-Samit رضي الله عنه : La tradition mentionnée ci-dessus (n° 4401) a aussi été transmise par Ubadah ibn as-Samit par une autre chaîne de rapporteurs. Cette version rapporte : Les gens dirent à Sa’d ibn Ubadah : AbuThabit, les peines prescrites ont été révélées : si tu trouves un homme avec ta femme, que feras-tu ? Il répondit : « Je les frapperai à l’épée jusqu’à ce qu’ils se taisent (c’est-à-dire meurent). Dois-je aller chercher quatre témoins ? Pendant ce temps, le besoin serait déjà satisfait. » Ils partirent alors voir le Messager d’Allah ﷺ et dirent : « Messager d’Allah ! As-tu entendu ce qu’a dit AbuThabit ? » Le Messager d’Allah ﷺ dit : « L’épée suffit comme témoin. » Puis il ajouta : « Non, non, un homme jaloux et furieux pourrait agir ainsi. » Abu Dawud a dit : Cette tradition a été transmise par Waki’ d’après al-Fadl b. Dilham d’après al-Hasan, d’après Qabisah b. Huraith, d’après Salamah b. al-Muhabbaq, du Prophète ﷺ. Et c’est la chaîne de la tradition rapportée par Ibn al-Muhabbaq à propos d’un homme ayant eu des rapports avec la servante de sa femme. Abu Dawud a dit : Al-Fadl b. Narrated Ubadah ibn as-Samit: The tradition mentioned above (No. 4401) has also been transmitted by Ubadah ibn as-Samit through a different chain of narrators. This version has: The people said to Sa'd ibn Ubadah: AbuThabit, the prescribed punishments have been revealed: if you find a man with your wife, what will you do? He said: I shall strike them with a sword so much that they become silent (i.e. die). Should I go and gather four witnesses? Until that (time) the need would be fulfilled. So they went away and gathered with the Messenger of Allah (ﷺ) and said: Messenger of Allah! did you not see AbuThabit. He said so-and-so. The Messenger of Allah (ﷺ) said: The sword is a sufficient witness. He then said: No, no, a furious and a jealous man may follow this course. Abu Dawud said: This tradition has been transmitted by Waki' from al-Fadl b. Dilham from al-Hasan, from Qabisah b. Huraith, from Salamah b. al-Muhabbaq, from the Prophet (ﷺ). And this is the chain of the tradition narrated by Ibn al-Muhabbaq to the effect that a man had sexual intercourse with a slave girl of his wife. Abu Dawud said: Al-Fadl b.
