Sunan Abi Dawud, 3399

Abu Ja’far al-Khatmi a dit : Mon oncle m’a envoyé, moi et son esclave, chez Sa’id ibn al-Musayyab. Nous lui avons dit qu’une information nous était parvenue au sujet du métayage. Il a répondu : « Ibn Umar ne voyait aucun mal à cela jusqu’à ce qu’un hadith de Rafi’ ibn Khadij lui parvienne. Il est alors allé le voir et Rafi’ lui a raconté que le Messager d’Allah ﷺ était venu chez Banu Harithah et avait vu une récolte sur la terre de Zuhayr. Il a dit : “Quelle belle récolte de Zuhayr !” Ils ont répondu : “Elle n’appartient pas à Zuhayr.” Il a demandé : “N’est-ce pas la terre de Zuhayr ?” Ils ont dit : “Oui, mais la récolte appartient à untel.” Il a dit : “Reprenez votre récolte et donnez-lui un salaire.” Rafi’ a dit : “Nous avons repris notre récolte et lui avons donné un salaire.” » Sa’id (ibn al-Musayyab) a dit : « Prêtez à votre frère ou employez-le pour des dirhams. »

AbuJa'far al-Khatmi said:My uncle sent me and his slave to Sa'id ibn al-Musayyab. We said to him, there is something which has reached us about sharecropping. He replied: Ibn Umar did not see any harm in it until a tradition reached him from Rafi' ibn Khadij. He then came to him and Rafi' told him that the Messenger of Allah (ﷺ) came to Banu Harithah and saw crop in the land of Zuhayr. He said: What an excellent crop of Zuhayr is! They said: It does not belong to Zuhayr. He asked: Is this not the land of Zuhayr? They said: Yes, but the crop belongs to so-and-so. He said: Take your crop and give him the wages. Rafi' said: We took our crop and gave him the wages. Sa'id (ibn al-Musayyab) said: Lend your brother or employ him for dirhams
