Sunan Abi Dawud, 3074

Rapporté par Urwah رضي الله عنه : Le Prophète ﷺ a dit : « Si quelqu’un cultive une terre stérile, elle lui appartient. » Il a ensuite transmis une tradition similaire à celle mentionnée plus haut (n° 3067). Il (‘Urwah) a dit : Celui qui m’a transmis ce récit a dit que deux personnes ont porté leur litige devant le Messager d’Allah ﷺ. L’un avait planté des palmiers sur la terre de l’autre. Il a décidé de rendre la terre à son propriétaire et a demandé à l’autre d’enlever ses palmiers. J’ai vu quand leurs racines étaient frappées à la hache. Les arbres étaient déjà grands, mais ils ont été retirés

Narrated Urwah: The Prophet (ﷺ) said: If anyone brings barren land into cultivation, it belong to him. He then transmitted a similar tradition mentioned above (No. 3067). He ('Urwah) said: One who transmitted this tradition to me said that two persons brought their dispute to the Messenger of Allah (ﷺ). One of them grew palm trees in the land of the other. He decided to return the land to its owner of the palm-trees to remove his palm-trees. He said: I saw when their roots were being struck with axes.
