Sunan Abi Dawud, 2301

Rapporté par Ibn ‘Abbas رضي الله عنه : « Le verset suivant a abrogé la règle selon laquelle une femme devait passer sa période d’attente chez sa famille : “Une année d’entretien et de résidence.” Désormais, elle peut passer sa période d’attente où elle le souhaite. ‘Ata a dit : “Si elle le souhaite, elle peut rester chez la famille de son mari et vivre dans la maison que son mari lui a laissée par testament. Ou bien, elle peut déménager si elle le veut, selon la décision d’Allah le Très-Haut. Mais si elles quittent la résidence, il n’y a pas de reproche à leur faire pour ce qu’elles font.” ‘Ata a ajouté : “Ensuite, les versets concernant l’héritage ont été révélés. L’obligation de rester un an dans la maison a été annulée. Elle peut désormais passer sa période d’attente où elle le souhaite.” »

Ibn ‘Abbas said “The following verse abrogated the rule of passing her waiting period with her people. A year’s maintenance and residence. She may pass her waiting period now anywhere she wishes. ‘Ata said “If she wishes she can pass her waiting period with the people of her husband and live in the house left by her husband by will. Or she may shift if she wishes according to the pronouncement of Allah the Exalted. But if they leave (the residence) there is no blame on you for what they do. Ata’ said “Then the verses regarding inheritance were revealed. The commandment for living in a house (for one year) was repealed. She may pass her waiting period wherever she wishes
