Sunan Abi Dawud, 2275

Rapporté par Rabah رضي الله عنه : Mon peuple m’a marié à une esclave romaine qui leur appartenait. J’ai eu des rapports avec elle et elle a donné naissance à un garçon noir comme moi. Je l’ai appelé Abdullah. J’ai encore eu des rapports avec elle, et elle a donné naissance à un autre garçon noir comme moi. Je l’ai appelé Ubaydullah. Ensuite, un esclave romain de mon peuple, appelé Yuhannah, l’a incitée et lui a parlé dans sa langue incompréhensible. Elle a donné naissance à un fils rougeâtre, comme un caméléon. Je lui ai demandé : « Qu’est-ce que c’est que cela ? » Elle a répondu : « C’est de Yuhannah. » Nous avons alors porté l’affaire devant Uthman رضي الله عنه pour qu’il tranche. Je pense que Mahdi a dit ces mots. Il les a interrogés tous les deux, et ils ont reconnu les faits. Il leur a alors dit : « Êtes-vous d’accord pour que je juge selon la décision du Messager d’Allah ﷺ ? Le Messager d’Allah ﷺ a décidé que l’enfant appartient à celui sur le lit duquel il est né. » Et je pense qu’il a dit : Il l’a fouettée, ainsi que l’homme, car ils étaient esclaves

Rabah said:My people married me to a Roman slave-girl of theirs. I had intercourse with her, and she gave birth to a black (male) child like me. I named it Abdullah. I again had intercourse with her, and she gave birth to a black (male) child like me. I named it Ubaydullah. Then a Roman slave of my people, called Yuhannah, incited her, and spoke to her in his own unintelligible language. She gave birth to a son like a chameleon (red). I asked her: What is this? She replied: This belongs to Yuhannah. We then brought the case to Uthman (for a decision). I think Mahdi said these words. He inquired from both of them, and they acknowledged (the facts). He then said to them: Do you agree that I take the decision about you, which the Messenger of Allah (ﷺ) had taken? The Messenger of Allah (ﷺ) decided that the child was to attributed to the one on whose bed it was born. And I think he said: He flogged her and flogged him, for they were slaves
