Sunan an-Nasa'i, 3549

It was narrated that Fatimah bint Qais said:"My husband divorced me and I wanted to move, so I went to the Messenger of Allah and he said: 'Move to the house of your paternal cousin 'Amr bin Umm Maktum, and observe your 'Iddah there.'" Al-Aswad hit him (Ash-Sha'bi) with a pebble and said: "Woe be to you! Why do you issue such a Fatwa? 'Umar said: 'If you bring two witnesses who will testify that they heard that from the Messenger of Allah (we will believe you), otherwise, we will not leave the Book of Allah for the word of a woman.' 'And turn them not out of their (husband's) homes nor shall they (themselves) leave, except in case they are guilty of some open Fahishah

Rapporté par Fatimah bint Qais : « Mon mari m’a divorcée et je voulais déménager, alors je suis allée voir le Messager d’Allah ﷺ et il a dit : “Va dans la maison de ton cousin paternel ‘Amr bin Umm Maktum, et observe ta ‘Idda là-bas.” » Al-Aswad lui a lancé un caillou et a dit : « Malheur à toi ! Pourquoi donnes-tu un tel avis ? ‘Umar a dit : “Si tu amènes deux témoins qui attestent avoir entendu cela du Messager d’Allah ﷺ, nous te croirons, sinon, nous ne délaisserons pas le Livre d’Allah pour la parole d’une femme.” “Et ne les faites pas sortir de leurs maisons (celles de leur mari) et elles ne doivent pas partir, sauf en cas d’indécence manifeste.” »
