Yahya related to me from Malik that he had read what Umar ibn al- Khattab had written about zakat, and in it he found: "In the name of Allah, the Merciful, the ompassionate." The Book of Zakat. On twenty-four camels or less zakat is paid with sheep, one ewe for every five camels. On anything above that, up to thirty-five camels, a she-camel in its second year, and, if there is no she camel in its second year, a male camel in its third year. On anything above that, up to forty-five camels, a she- camel in its third year. On anything above that, up to sixty camels, a she camel in its fourth year that is ready to be sired. On anything above that, up to seventy-five camels, a she-camel in its fifth year. On anything above that, up to ninety camels, two she-camels in their third year. On anything above that, up to one hundred and twenty camels, two she-camels in their fourth year that are ready to be sired. On any number of camels above that, for every forty camels, a she-camel in its third year, and for every fifty, a she-camel in its fourth year. On grazing sheep and goats, if they come to forty or more, up to one hundred and twenty head, one ewe. On anything above that, up to two hundred head, two ewes. On anything above that, up to three hundred, three ewes. On anything above that, for every hundred, one ewe. A ram should not be taken for zakat. nor an old or an injured ewe, except as the zakat-collector thinks fit. Those separated should not be gathered together nor should those gathered together be separated in order to avoid paying zakat. Whatever belongs to two associates is settled between them proportionately. On silver, if it reaches five awaq (two hundred dirhams), one fortieth is paid

Yahia a rapporté que Malek a dit: qu'il a lu les renseignements prescrits par Omar Ibn Al-Khattab relatifs à la zakat, et il y trouva: - Pour vingt et quatre chameaux, (24) ou d'un nombre inférieur, la zakat est d'un monton pour chaque cinq chameaux. - Pour un nombre au-delà de vingt et quatre, (24) atteignant les trente et cinq, (35) y compris, le zakat est d'une Chamelle d'un an révolu, sinon, un chameau de deux ans révolus. - Pour un nombre variant entre trente et cinq, (35) et quarante et cinq, (45) une chamelle de deux ans révolus. - Pour ce qui est entre quarante et six, (46) jusqu'à soixante, (60) y compris, une chamelle de trois ans révolus et prête à la copulation. Entre soixante et un (61) et sixante et quinze, (75) y compris, une chamelle de quatre ans révolus. - De soixante et seize (76) à quatre vingt et dix, (90) deux chamelles de deux ans révolus. - De quatre-vingt et onze, (91) à cent et vingt, (120) deux chamelles de trois ans révolus et prêtes à la copulation. - Pour tout ce qui est au-delà de cent-vingt et un, (121) une chamelle d'un an révolu pour chaque quarante (40) chameaux, et une chamelle de trois ans révolus prête à la copulation pour chaque cinquante (50). - Pour ce qui est des moutons: quarante à cent et vingt (de 40 à 120) un mouton. - Pour ce qui est entre cent-vingt et un (121) et deux cent, (200) la zakat est de deux moutons. - De deux cent et un (201) à trois cent, (300) trois moutons. - De trois cent et un (301) et au-delà de ce nombre, un mouton pour chaque centaine. - D'autre part, on ne doit pas faire l'aumône, ni d'un bouc, ni d'une bête âgée, ni d'une bête qui a perdu un membre, à moins que le collecteur n'accepte de la prendre». - Il ne faut pas grouper deux lots, ni séparer un groupe de deux lots à cause de la zakat. - Au cas où il ya un mélange de deux lots, où on ne peut pas les distinguer, les deux propriétaires doivent la zakat. - En ce qui concerne l'argent, la zakat est le quart du dixième si le poids est égal ou dépasse cinq onces.
