Pre-emption in Property
Sahih (authentic)by Salim al-Hilali
Yahya related to me from Malik from Ibn Shihab from Said ibn al- Musayyab and from Abu Salama ibn Abd ar-Rahman ibn Awf that the Messenger of Allah, may Allah bless him and grant him peace, decreed for partners the right of preemption in property which had not been divided up. When boundaries had been fixed between them, then there was no right of pre-emptionAbou Salama Ibn Abdul Rahman Ibn Awf a rapporté que l'Envoyé d'Allah (salallahou alayhi wa salam) r (Sur lui la grâce et la paix d'Allah) a commandé que la préemption soit appliqué dans tout ce qui n'a pas été divisé entre les partenaires, mais si la délimitation des parts a eu déjà lieu, plus question de préemption». Malek a dit: «Telle est la sounna incontestablement suivie»Grades given by scholars
