Muwatta Malik, 1230

Yahya related to me from Malik that he had heard that Ali ibn Abi Talib said about the two arbiters about whom Allah, the Exalted, said,"If you fear a breach between the two, appoint an arbiter from his people, and an arbiter from her people. If they desire to set things aright, Allah will make peace between them, surely Allah is Knowing, Aware," (Sura 4 ayat 35), that the separation and the joining were overseen by the two of them. Malik said, "That is the best of what I have heard from the people of knowledge. Whatever the two arbiters say concerning separation or joining is taken into consideration

On rapporta à Malek que Ali Ibn Abi Taleb a dit au sujet des deux arbitres, ce qui a été mentionné par Allah dans ce verset (le sens): «Si vous craignez la séparation entre les deux conjoints, suscitez un arbitre de la famille de l'époux et un arbitre de la famille de l'épouse. Allah rétablira la concorde entre eux d'eux, s'ils veulent se réconcilier. Allah est celui qui sait et qui est bien informé» Coran IV, 35. Cela s'explique ou de la séparation ou de la réunion des deux conjoints. - Malek a finalement dit: «Et c'est ce que j'ai de mieux entendu dire des hommes versés, à savoir que les deux arbitres ont le droit de juger entre l'homme et sa femme, séparant entre eux ou les réunissant».
