Sahih al-Bukhari, 1588

Narrated 'Usama bin Zaid:I asked, "O Allah's Messenger (ﷺ)! Where will you stay in Mecca? Will you stay in your house in Mecca?" He replied, "Has `Aqil left any property or house?" `Aqil along with Talib had inherited the property of Abu Talib. Jafar and `Ali did not inherit anything as they were Muslims and the other two were non-believers. `Umar bin Al-Khattab used to say, "A believer cannot inherit (anything from an) infidel." Ibn Shihab, (a sub-narrator) said, "They (`Umar and others) derived the above verdict from Allah's Statement: "Verily! those who believed and Emigrated and strove with their life And property in Allah's Cause, And those who helped (the emigrants) And gave them their places to live in, These are (all) allies to one another

Rapporté par ‘Usama ibn Zaid : J’ai demandé : « Ô Messager d’Allah (ﷺ) ! Où vas-tu séjourner à La Mecque ? Vas-tu rester dans ta maison à La Mecque ? » Il a répondu : « Est-ce qu’Aqil a laissé une propriété ou une maison ? » Aqil et Talib avaient hérité des biens d’Abu Talib. Ja‘far et ‘Ali n’avaient rien hérité car ils étaient musulmans, tandis que les deux autres ne l’étaient pas. ‘Umar ibn Al-Khattab disait : « Un croyant ne peut pas hériter d’un non-croyant. » Ibn Shihab (un des rapporteurs) a dit : « ‘Umar et les autres ont tiré ce jugement de la parole d’Allah : “En vérité, ceux qui ont cru, émigré et lutté avec leurs biens et leurs vies pour la cause d’Allah, et ceux qui leur ont donné refuge et secours, ceux-là sont alliés les uns des autres.” »
