Sunan Abi Dawud, 2278

Narrated Ali ibn AbuTalib: Zayd ibn Harithah went out to Mecca and brought the daughter of Hamzah with him. Then Ja'far said: I shall take her; I have more right to her; she is my uncle's daughter and her maternal aunt is my wife; the maternal aunt is like mother. Ali said: I am more entitled to take her. She is my uncle's daughter. The daughter of the Messenger of Allah (ﷺ) is my wife, and she has more right to her. Zayd said: I have more right to her. I went out and journeyed to her, and brought her with me. The Prophet (ﷺ) came out. The narrator mentioned the rest of the tradition. He (i.e. the Prophet) said: As for the girl, I decided in favour of Ja'far. She will live with her maternal aunt. The maternal aunt is like mother

Rapporté par Ali ibn Abu Talib رضي الله عنه : Zayd ibn Harithah est allé à La Mecque et a ramené la fille de Hamzah. Ja'far a dit : « Je veux la prendre ; j’y ai plus de droits, c’est la fille de mon oncle paternel et sa tante maternelle est mon épouse ; la tante maternelle est comme une mère. » Ali a dit : « J’y ai plus de droits, c’est la fille de mon oncle paternel. La fille du Messager d’Allah ﷺ est mon épouse et elle a plus de droits sur elle. » Zayd a dit : « J’y ai plus de droits, c’est moi qui suis allé la chercher et l’ai ramenée. » Le Prophète ﷺ est sorti. Le narrateur a mentionné la suite du récit. Il (le Prophète) a dit : « Quant à la fillette, j’ai statué en faveur de Ja'far. Elle vivra avec sa tante maternelle. La tante maternelle est comme une mère. »
