سنن أبي داود 2894

Narrated Qabisah ibn Dhuwayb: A grandmother came to AbuBakr asking him for her share of inheritance. He said: There is nothing prescribed for you in Allah's Book, nor do I know anything for you in the Sunnah of the Prophet of Allah (ﷺ) Go home till I question the people. He then questioned the people, and al-Mughirah ibn Shu'bah said: I had been present with the Messenger of Allah (ﷺ) when he gave grandmother a sixth. AbuBakr said: Is there anyone with you? Muhammad ibn Maslamah stood and said the same as al-Mughirah ibn Shu'bah had said. So AbuBakr made it apply to her. Another grandmother came to Umar ibn al-Khattab asking him for her share of inheritance. He said: Nothing has been prescribed for you in Allah's Book. The decision made before you was made for a grandmother other than you. I am not going to add in the shares of inheritance; but it is that sixth. If there are two of you, it is shared between you, but whichever of you is the only one left gets it all

Rapporté par Qabisah ibn Dhuwayb : Une grand-mère est venue voir Abu Bakr pour demander sa part d’héritage. Il a dit : « Rien n’est prescrit pour toi dans le Livre d’Allah, et je ne connais rien pour toi dans la Sunna du Prophète d’Allah ﷺ. Rentre chez toi pendant que je consulte les gens. » Il a alors interrogé les gens, et al-Mughirah ibn Shu'bah a dit : « J’étais présent avec le Messager d’Allah ﷺ lorsqu’il a donné un sixième à la grand-mère. » Abu Bakr a dit : « Y a-t-il quelqu’un d’autre avec toi ? » Muhammad ibn Maslamah s’est levé et a confirmé ce qu’a dit al-Mughirah ibn Shu'bah. Abu Bakr a donc appliqué cette règle. Une autre grand-mère est venue voir Umar ibn al-Khattab pour demander sa part d’héritage. Il a dit : « Rien n’est prescrit pour toi dans le Livre d’Allah. La décision prise avant toi l’a été pour une autre grand-mère que toi. Je n’ajouterai rien aux parts d’héritage ; mais c’est ce sixième. S’il y en a deux, elles se le partagent, mais si tu es la seule, tu prends tout. »
