سنن أبي داود 2114

Narrated Abdullah ibn Mas'ud: Masruq said on the authority of Abdullah ibn Mas'ud: Abdullah (ibn Mas'ud ) was asked about a man who had married a woman without cohabiting with her or fixing any dower for her till he died. Ibn Mas'ud said: She should receive the full dower (as given to women of her class), observe the waiting period ('Iddah), and have her share of inheritance. Thereupon Ma'qil ibn Sinan said: I heard the Messenger of Allah (ﷺ) giving the same decision regarding Birwa' daughter of Washiq (as the decision you have given)

Rapporté par Abdullah ibn Mas’ud رضي الله عنه : Masruq a rapporté d’après Abdullah ibn Mas’ud qu’on lui demanda au sujet d’un homme qui avait épousé une femme sans avoir eu de rapports avec elle ni fixé de dot jusqu’à sa mort. Ibn Mas’ud répondit : « Elle doit recevoir la dot complète (comme les femmes de son rang), observer la période d’attente (‘iddah) et avoir sa part d’héritage. » Ma’qil ibn Sinan dit alors : « J’ai entendu le Messager d’Allah ﷺ donner la même décision concernant Birwa’, fille de Washiq (comme celle que tu viens de donner). »
